Terms and Conditions of Use

OncoTrials MY is a digital support and coordination tool. It is designed to help patients, families, clinicians, researchers, principal investigators, contract research organisations (CROs), sponsors, and other stakeholders understand and navigate cancer clinical trials in Malaysia.

The Platform does not replace, and is not a substitute for, the professional judgement, advice, diagnosis, treatment, or care provided by a clinician, researcher, principal investigator, CRO, or clinical trial site.

Nothing on the Platform creates a doctor and patient relationship, a clinical relationship, or any professional advisory relationship between you and OncoTrials MY, its team, or any oncologist or other professional associated with it.

All decisions about your health, your treatment, or your participation in a clinical trial must be made together with qualified healthcare professionals who know your individual medical circumstances.

The Platform does not provide medical advice, diagnosis, or treatment.

If you think you may have a medical emergency, contact your doctor, the nearest hospital emergency department, or emergency services (999 in Malaysia) immediately. Do not delay seeking professional medical advice because of something you have read on the Platform.

You agree to use the Platform responsibly, lawfully, and only for its intended purpose, which is to support access to information about cancer clinical trials in Malaysia.

You must not misuse the Platform or abuse the information made available through it. This includes, without limitation:

• using the information to mislead, deceive, or harm any person;
• presenting trial information as personalised medical advice, or relying on it in place of professional medical advice;
• attempting to gain unauthorised access to the Platform, its data, or another person's information;
• scraping, harvesting, or redistributing Platform content without written permission;
• submitting false or misleading data, or another person's personal data without their consent.

To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless OncoTrials MY, its founders, officers, employees, contractors, partners, and affiliates from and against any and all claims, actions, losses, damages, liabilities, penalties, and costs (including reasonable legal fees) arising from or connected to your misuse or abuse of the Platform or of the information obtained through it, your breach of these Terms, or your violation of any law or third-party right.

Trial listing, trial status, inclusion and exclusion criteria, and listed sites shown on the Platform are retrieved from ClinicalTrials.gov, a public registry maintained by the United States National Library of Medicine, together with information supplied by trial sites, sponsors, and other contributors.

OncoTrials MY is not responsible for the accuracy, completeness, currency, or availability of the information provided from ClinicalTrials.gov. Registry records may be incomplete, out of date, or amended without notice.

Always confirm the details of any trial, including its current status, eligibility criteria, and participating sites, directly with the trial site or sponsor before making any decision. Never rely on the Platform alone to establish your eligibility for a trial.

Some features use artificial intelligence to assist with searching, matching, and coordination. AI output can be incomplete or incorrect.

AI-assisted results, scores, and suggestions are for guidance only. They are not an eligibility determination, not a clinical assessment, and not a substitute for review by a qualified professional.

When you register, submit an enquiry, or create a profile on the Platform, you agree to:

• provide accurate, current, and complete information;
• keep your login credentials confidential and tell us promptly about any unauthorised use;
• use the Platform only if you are legally able to accept these Terms;
• ensure you have consent before submitting another person's personal data.

We handle personal data in accordance with the Personal Data Protection Act 2010 of Malaysia (PDPA) and our published privacy notice.

We collect the personal data you provide, such as your name, contact details, country, role, and message, so that we can respond to your enquiry, connect you with the relevant trial services, and improve the Platform.

Your details go only to the OncoTrials MY team, and are deleted from our system once the team has received them and acted on them.

You may withdraw your consent, or request access to or correction of your personal data, at any time by contacting us.

The Platform, including its design, text, graphics, logos, and software, is owned by or licensed to OncoTrials MY and is protected by applicable intellectual property laws.

You may view and print content for your own personal, non-commercial use. Any other use, including reproduction, modification, distribution, or commercial exploitation, requires our prior written consent.

Content retrieved from ClinicalTrials.gov remains subject to its own terms of use.

The Platform may reference or link to third-party websites, registries, publications, and videos, including Oncology TV and ClinicalTrials.gov.

We do not control, and are not responsible for, the content, accuracy, availability, or practices of third-party sources.

To the fullest extent permitted by law, OncoTrials MY, its team, partners, and affiliates are not liable for any direct, indirect, incidental, special, consequential, or punitive loss or damage arising from your use of, or inability to use, the Platform, including reliance on any information retrieved from ClinicalTrials.gov or any third party.

Nothing in these Terms excludes any liability that cannot lawfully be excluded under Malaysian law.

The Platform is under active development. Features, trial coverage, and availability may change, be suspended, or be withdrawn at any time, including before and after the public launch.

We may update these Terms from time to time. A revised version takes effect when it is posted on the Platform, and continued use of the Platform means you accept it.

We may suspend or end your access if you breach these Terms, or use the Platform in a way that risks harm to others.

These Terms are governed by the laws of Malaysia, and any dispute arising from them is subject to the exclusive jurisdiction of the courts of Malaysia.
